0. Plain English first
These are the terms under which AUBOSmail (operated by AUBOS Inc., "we") provides email infrastructure to you ("you"). Don't spam, don't phish, don't do anything illegal, pay your invoices on time, and we'll keep your service running, your data secure, and your sends provable. We sign DPAs and custom MSAs for enterprise customers — talk to us.
1. The service
AUBOSmail provides: (a) personal email accounts on the @aubosmail.com shared domain; (b) business email infrastructure with custom sender domains; (c) cold-outreach sequencing; (d) per-send analytics; (e) cryptographic proof receipts. Specifics by plan are at /pricing.
2. Your account
You agree to provide accurate signup info, keep your credentials secret, and notify us at security@aubosmail.com if your account is compromised. We may suspend accounts where we reasonably suspect compromise or violation of these terms.
3. Payment
Personal accounts are free. Paid plans bill monthly or annually via Stripe. You authorize recurring charges until you cancel. Annual plans are non-refundable except in regions where consumer-protection law requires otherwise. Late payments accrue interest at 1.5%/month or the legal maximum, whichever is lower.
4. Acceptable use
You may not use AUBOSmail to send:
- Unsolicited bulk email to recipients who haven't consented (spam).
- Phishing, credential-harvesting, or impersonation of other organizations.
- Malware, exploit payloads, or links to drive-by-download pages.
- Content that violates intellectual property, defames a person, or incites violence.
- Sexual content involving minors. Reported instantly to NCMEC.
- Content that violates applicable export controls or sanctions (OFAC, EU, UK).
- High-risk regulated content (cryptocurrency airdrop spam, MLM recruitment, multi-level affiliate scams) without our explicit written approval.
We use complaint-rate, suppression-list, and AI-content classifiers to detect violations. We may suspend or terminate accounts for repeated violations, and we comply with valid legal process (subpoenas, search warrants).
5. Compliance is your responsibility
You are responsible for ensuring you have lawful basis to email your recipients (consent, contract, legitimate interest, etc.) under whatever law applies. We provide tools (jurisdiction classification, suppression list, consent records) to help, but we don't make your legal decisions for you. CAN-SPAM (US), CASL (Canada), GDPR (EU), UK GDPR, Australian Spam Act — you're the data controller; we're the processor.
6. Service levels
Personal and Business plans: best-effort uptime, target 99.5%. Scale plan: 99.9% SLA with service credits per a written SLA agreement. Scheduled maintenance is announced 7 days in advance via email + dashboard banner.
7. Suspension & termination
We may suspend or terminate your account immediately for: (a) non-payment after 14 days past due; (b) acceptable-use violation that risks our infrastructure or other customers; (c) court order. We'll give you 30 days' notice for any other termination, with reasonable opportunity to export your data.
On termination: we delete your account data within 30 days, except for the immutable proof ledger (the cryptographic record of what you sent stays — without identifying body content — so recipients can still verify historical messages). Your audit log (separate from proof) is retained 7 years per legal requirement.
8. Intellectual property
We don't claim ownership of your content. You grant us the limited licenses needed to: (a) deliver email on your behalf; (b) store proof bundles per the retention you contracted; (c) operate the service. The grant terminates 30 days after account closure, except for the immutable proof ledger.
We retain ownership of AUBOSmail itself: software, designs, brand, logos, the proof protocol documentation. The proof verification protocol is openly published at /security so anyone can verify proofs without us — but the AUBOSmail name and implementation are ours.
9. Disclaimers
The service is provided "as is" and "as available." We disclaim implied warranties (merchantability, fitness for a particular purpose) to the maximum extent legal. Email delivery depends on third-party MTAs and ISPs we don't control; we don't guarantee any specific message will reach any specific recipient at any specific time.
10. Liability
To the maximum extent legal, our aggregate liability for any claim arising from the service is capped at the amount you paid us in the 12 months before the claim. We're not liable for indirect, consequential, or punitive damages, lost profits, or data loss arising from your own deletion or third-party action.
Some jurisdictions don't allow these limits — the above applies to the maximum extent legal in your jurisdiction.
11. Indemnification
You agree to indemnify us against third-party claims arising from your content, your use of the service, your violation of acceptable use, or your violation of someone else's rights. We'll notify you promptly and let you control defense if you wish.
12. Governing law & disputes
Governing law: State of Delaware, USA, without regard to conflict-of-laws rules. Disputes are resolved in Delaware state or federal courts, except that either party may seek injunctive relief in any court of competent jurisdiction.
Class-action waiver: claims must be brought individually, not as part of a class action, to the maximum extent legal. EU consumer-protection law may override this in your jurisdiction.
13. Changes
If we change these terms materially, we'll email you 30 days in advance. Continued use after the effective date means you accept the new terms. If you don't, you can cancel anytime per Section 7.
14. Miscellaneous
Entire agreement, severability (if one clause is unenforceable, the rest survives), no waiver (failing to enforce a clause once doesn't waive it later), no assignment without our consent (we may assign on M&A), force majeure for events outside reasonable control.
